GENERAL TERMS AND CONDITIONS (GTC)

The following General Terms and Conditions (GTC) apply to all orders placed through the online shop www.heimweh-home.de, which is operated by Schott-RP GmbH.

1. GENERAL AND SCOPE OF APPLICATION

1.1 Schott-RP GmbH operates an online shop for furniture and home products on the website www.heimweh-home.de.

1.2 Persons must be at least 18 years old to use the offers on the website www.heimweh-home.de.

1.3 Goods are generally sold only in quantities typical for household use.

1.4 These GTC apply to all contracts concluded via the website www.heimweh-home.de.

1.5 If working days are specified as deadlines, these refer to all weekdays except Saturdays, Sundays, and public holidays.

2. CONTRACTING PARTY, LANGUAGE AND CONCLUSION OF CONTRACT

2.3 By submitting an order via the "Buy now" button, you place a binding offer to purchase the goods in the shopping cart.

2.4 After receipt of your order, you will receive an order confirmation by e-mail. This does not yet constitute acceptance of the contract.

2.5 The purchase contract is only concluded by a separate shipping confirmation by e-mail or by shipping the goods.

4. PRICES AND SHIPPING COSTS

4.1 The prices indicated at the time of the order apply.

4.2 All prices include the statutory value-added tax.

4.3 Shipping costs are shown separately in the ordering process.

5. SHIPPING AND DELIVERY

5.1 Delivery takes place within Germany and to selected countries of the European Union.

5.2 Shipping costs are calculated at a flat rate per order.

5.3 Delivery is made via parcel service providers or freight forwarders.

5.4 The delivery time is indicated on the respective product page.

6. ACCEPTANCE OF GOODS AND TRANSPORT DAMAGES

6.1 Upon receipt of the goods, it must be checked whether there are visible damages to the packaging or goods.

6.2 If transport damages are found, these should be noted immediately with the delivery person.

6.3 Transport damages must be reported to customer service without delay.

7. PAYMENT TERMS AND PAYMENT

9. RETENTION OF TITLE

9.1 The goods remain the property of Schott-RP GmbH until full payment.

10. RIGHT OF WITHDRAWAL

10.1 You have the right to withdraw from this contract within 14 days without giving any reason.

10.2 The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

10.4 To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

11. VOLUNTARY RIGHT OF RETURN (30 DAYS)

11.1 In addition to the statutory right of withdrawal, Schott-RP GmbH grants a voluntary right of return of a total of 30 days from receipt of the goods.

11.2 The prerequisite is that the goods are unused, in perfect condition and, if possible, returned in their original packaging.

11.3 The cost of return shipping is borne by the customer.

11.4 The statutory right of withdrawal remains unaffected by this voluntary right of return.

12. CONSEQUENCES OF WITHDRAWAL

12.1 If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

12.2 We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

12.3 We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

12.4 You shall send back or hand over the goods to us without undue delay and in any event not later than 30 days from the day on which you communicate your withdrawal from this contract to us.

12.5 You will bear the direct cost of returning the goods.

12.6 You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

14. WARRANTY

14.1 The statutory warranty rights apply.

14.2 The warranty period is 24 months from delivery.

15. LIABILITY

15.1 Schott-RP GmbH is fully liable for intent or gross negligence as well as for damages resulting from injury to life, body or health.

15.2 In the event of slight negligence in breaching essential contractual obligations, liability is limited to the foreseeable damage.

16. COPYRIGHT

16.1 The content and works on this website are subject to German copyright law.

16.2 Any use outside the limits of copyright law requires the prior consent of the copyright holder.

17. ALTERNATIVE DISPUTE RESOLUTION

17.1 Schott-RP GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

18. FINAL PROVISIONS

18.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

18.2 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
